Hello,
I'd like to know can a dependent (not the prime applicant) on a pending 485 status, avail unemployment insurance, especially the extended benefits which are being given by Federal govt. to the states.
This is the latest from USCIS :

it says, that unemployment compensation is not public charge.
Does it even apply to both standard unemployment insurance and the extended benefits.

Hello all. This is a basic question: Are all 501(c) employers exempt from the H1 cap? I have heard and read so much about some non-profits being exempt from the H1 cap, but no one could tell me with certainty which ones.

On a serious note, you just have to inform your (dependent's) employer and provide them a copy of your unexpired EAD. Thats it! The employer may require you to fill a new I9 form.

I am working for a consultancy company at direct client location. My client has filed a H1B transfer petition for me with job title as Lead Business Analyst. My current job title with consulting company is programmer analyst. My question is that if I go for visa stamping with new employer�s I797, will I have any issues in visa stamping if they see the change in job title from programmer analyst (consulting company) to Lead Business Analyst (Full time)?

I came to US with H1 on Apr 2009. My wife who was working in the same company as I do, joined me on Dec 2009 with H4 visa. My H1 has expired on June 18 '10. I have applied for H1 extension much before and currently my status is pending with USCIS. Along with my H1 extension I have also applied for my wife's H4 extension. Her status is also pending.
My company has actually filed H1 visa for my wife for 2011 H1B quota.
I have the following questions, can someone kindly answer the same.
i) If my wife gets her H1 petition approved, should she travel back to my country to get it stamped and for her to work here in US?
Some say she should go back and some say she can start working here with her I797 notice, she can get it stamped whenever she goes to my country. Which is true?
ii) Assuming I get approval for my H1 extension and her H4 extension, should she get H4 extension stamped as well?
iii) Can she go for stamping for H1 as well as H4 in my country, if so which one should she go for first?

My 6 yr H1B is expiring within 4 months, my company will be filing for the 7th yr extension. Will there be any problem if I send my inlaws for visitor visa now.

I finally got my BC from India, now my lawyer tells me that it should have Mothers maiden name, Is that right? I cannot find any info which says that.
Birth certificates formats are entirely local. In India each state; maybe even each district has its own format. Your lawyer may have seen some that has this information, or s/he simply does not believe you that what you got is the genuine one. In any case, USCIS does not (and cannot) require any specific format.

I have concurrent filed I140 and 485 in Aug 2007. My I 140 is still pending. Can some one let me know what could be the reason. Is there any one whose i140 is pending since last three years.I am worried because processing time is around 4-6 months.Any help in this regard will be appriciated.

Hi! My drivers license has expired which was issued in Indianapolis, and I renewed the drivers license at Indianapolis which I could not get transferred to Florida ( no mail forwarding). Now question is, I want to renew new drivers license from Florida, will there be any problem if I use my old H-1B which was issued at Indianapolis, although I have shifted to Florida in a new job where my old H-1B transfer is till under process? what will the implications of using the old H1B?( I am still getting paid from my old employe)r

I am in an awkward position and any help will be greatly appreciated. Here is the run down:
- I am currently on an H1B that is scheduled to expire on May 15th, 2007 as per the stamp on my passport.
- I have accepted employment with another organization based on my EAD (485+140).
- The catch is that I plan to re-enter the US on April 21st, 2007(Saturday) but technically my employment will cease with the employer who filed my H1B on April 20th (Friday).
- I have applied for my travel document (I131-based on 485) but it will probably not arrive before I leave the country.
Questions:
- Can I re-enter on my H1B, although technically my employment ceased a day earlier?
- When do H1B�s technically expire after termination of employment?
