Hi,

I'm GC holder and i've applied for reentry permit and the validity is 2 yrs.
I've been living in INDIA for the past 10 months and now i want to go back to US.
I'd been filing my taxes and all but was not working for any US company for the past 10 months.
Will there be any issues at the POE when i return to US?..Usually POE officer asks the questions like where do you work and what was the reason you went to INDIA..

Is it Ok to tell the officer that i'm not working?

I recently got an RFE for my I 485 Application.

Need to prove my non-immigration status from Nov 29 2007 to Nov 24 2008 .

I have I-797 ( H1-B approval ) for the above mentioned period. But My Last Name in the approval has a typo error ( in place of letter A they misstyped U). My Enployer has opened a Service request to correct the Name in H1 B approval. But he is saying that he never got the corrected approval. Time went by and i applied for H1 ext..i got the H1 extension from Nov 25 2008 to Nov 2011.

So My question is

Is it okay to submit all the documention that was sent to USCIS to correct the name along with the I 797,I-94 for the above mentioned period and explain them that we did not recieved the corrected I-797 ? or not

Please suggest me ..

I work for company A. I am on a project actively with an end client from last one year. My company A stopped paying me from past 5 months in spite of them getting paid from the vendor. I have requested my company to release all my payments pending from last 5 months repeatedly. But they don't seem to bother. I am planning to change my employer now.

My question is Am i out of status since I am not getting paid from last 5 months? I have luckily all the copies of pay stubs till a month ago. Only thing is that I haven;t received them yet. Please let me know

Hi,
My L1B visa & petition with Company A runs upto Sep this year.
I'm applying for H1B petition with company B this year.
my current Company A will try to go for L1B petition extension, so that I can continue being here beyond september.

My concern is if these 2 will clash with each other ?

One of my friends said that whichever petition gets approved latest - will be the one that holds good.

So if L1B extension gets approved after h1B, will that negate H1B ?
and vice-versa ..

Hi,

I am currently a dependent E-1 on my wife's visa and currently have a valid EAD which will expire mid-2010.

We are about to file I-140 and I-485 and my question is, should I also file for a new EAD at the same time even if its still 8 months from expiry? I'm not sure what the difference is between an EAD under the E-1 visa, or an EAD when filing the I-485, or if it doesn't matter at all.

I'm not sure how much it would help, but you might try using fill flash (that still won't solve the background issue). Shooting on a day that's not overcast might help bring the sky into range.

Hi,
My H1B 6 years will be finished in February. My I140/485 were filed in August and I will be laid off on December 31. What options do I have now?

- My employer had filed my immigration papers at my current work location. They are willing to relocate me to different location but are not sure on the impact of change in address. Can I relocate with my current 140/485 filed for current address?

- Can my H1 be extended based on approved labor? I can then move to new location with same employer on renewed H1B and start the entire process again?

Guys,
I need to find out what documents I need to send after I file I-765 online. DO anyone has the experience in this matter. I filed my I-485 and at tht time i did not filed my I756 just to avoid lawyer's fee.

The form says I need to send a copy of I-94 and photo thats all, but the confirmation notice I received after filing the form online said that do not send any photo's or any identification document and the notice said that they will sent me a Biometric appointment.

DO anyone has info on this

Whatever you call it, you are really always applying for a new EAD. There is no such thing as renewing an existing EAD. The I-765 form that you complete will ask about any prior EADs that you had. If you do not have details, please put as close to the facts as possible. If you still have a CIS receipt number, definitely include that so CIS can look up the details.

Please correct me if i am wrong.

WH-4 Time line is within a year, means if betrayel/non payment happened with in a year from the date of reporting it will be investigated, and YOU CAN FILE WH-4 FROM OUTSIDE OF US ALSO, if your consultant company sent you back with fake commitments.

But not sure if your h1 still have time, after DOL complain, you can transfer it or not??

Anyone has any idea???

I have this very tough situation.

I have an approved I -140 from previous employer and 6 years is over in USA.
I got a H1B transfer to a different employer last year ( 2009 ) based on this approved I 140 ( H1B was approved around Aug 2009 - given till March 2011 ).
Now I filed for another H1B transfer to another employer. But around September 2009, the previous I 140 was revoked ( this revocation is normal one and not for fraud ). I didn't know about that. So an RFE came for the new H1B transfer since my I 140 was revoked. I don't have a GC on file right now. I had the impression that normal revocation of I 140 doesn't effect H1B transfer. PLEASE HELP!! What are my options?

Need urgent help.

I have files my visa (H1B), where I have diffence in my first name printed in my passport than on all my degree certificates.

In my 10th standard certifciate it was printed as "Gorav" should have been "Gaurav". But in all my degree certificates it's "Gaurav".

My last name is same in all certificates, passport etc.
My parents name and Date of birth and home address is also same in all certificates and passport.

When I filed my H1B I filled up my first name as "Gorav" (as it is in passport).

What shall I do know? Will it have any impact on my visa approval?

What shall I do before they ask me for any question?

Please help as it's time sensitive issue

I was on H1B until Feb 2009 and I applied for COS to H4 in Feb 2009. USCIS has received my COS application, and it is still pending with USCIS for 2 months now.

1. Can a new employer apply for a new cap-exempt H1B for me (technically a transfer, as I was on H1B for 2 years before)?
2. In that case, do I need to submit paystubs and W2s from when I last held H1B status?

The initial draft needs to be sent back by the lawyer for signatures and then the file can go out.

Hi,

My H1B Visa expires in Aug 2009 (it was after first extension, till date i have already consumed 3 years 6 months in US). I have following questions,

1. After filing the extension next month, Can I leave to India immediately after getting the receiept (before approval). I might plan to come back to US after a year or so! I will be working at offshore for the same company.

2. If i leave a gap of 365 days, would i regain full 6 years after my re-entry in USA with the existing Visa itself?

I am very sorry if this is a repeated question, i did spend ample time investigating this query and then decided to post this in a thread.

Recently I transferred my H1 to another company. My H1 and my wife�s H4 got expired on last August 2nd 2007. However, the new company filed H1B application and it got approved 2 weeks back, but forgot to file for H4 extension for my wife. My company is saying they will file for H4 extension (I-539) now, even though her visa/I-94 got expired and she doesn�t have to go back home. Do you think they are on right track? Hello. I am playing around with making a little app that allows me to draw a polygon shape and then determine how many rectangles can fit inside that shape. The rectangles only have two widths, but can be as long as needed.

It occurred to me that I might somehow be able to have that polygon shape act like a wrap panel and the rectangles inside would self-adjust based on the space provided. Two questions:

1) Is it possible to make a wrap panel with custom borders (not just rectangular)?
2) Is there an equivalent component, to the wrap panel, in Flash? If so, can that component have custom borders?

Yes you should furnish this info. One of the forms asks for details of previous marriages which you should provide. I think you will also need to provide your divorce decree. Providing the information does not impact your application one way or the other.

Hi ,

There is a job opening at client place and job opening title is "JAVA DEVELOPER/SR JAVA ENGINEER" and the responsibilities includes coding Java. I do not have approved Labor certification with me but my Labor application (Signed copy by me) say Job Title as "Programmer/Analyst" and responsibilities includes
"Analyze, design and develop applications using C++, Java, J2EE and Oracle."

Could you please let me know if I can work on EAD for the above job position at the
client place using AC21? I prefer not to talk with client if the labor and client job

It is advisable to file change of status to h4 while in USA, no need to go back to India. After you get your h4 approved then you can go for stamping...

That is good approach, if
1. one is maintaining status at the time of H-4 Change of status application
AND
2. Person is not traveling out of USA in short term future

I was scheduled for Infopass today and found out the alien number assigned to my I-485 application is not the one mentioned in I-140 and belongs to somebody else in florida. I called NSC and they processed the service request and told me to wait for 45 days. I talked to NSC directly and without checking my application details, the officer tried to assure me that it is something that they will be able to fix when they will adjudicate my case. My EAD and fingerprinting were cleared under the wrong alien number and my lawyer told me that the alien number is assigned by USCIS. I will check my documents to find out if they did that mistake.

Anyone else got in similar situation or know about someone with the same issue?

My company applied for my 140 (Substitute) in Premium processing (before it was stopped) and I recieved an RFE for ability to pay. Company took sometime & responded with Tax returns.

Online status says, response to RFE recieved and the processing resumed. Since mine is a PP, I epxected the result in 15 days...but its more than a month...

So I contacted my employer & he says USCIS asked for "Audited Financial statement". But online status did not change. (Still says, we recieved your response & case processing is resumed).

Is it possible that USCIS just asks for more information in reponse to RFE but still does not update the status?? What I don't understand is - normally USCIS Deny the app if they are not OK with my employer's initial response is n't it? how are they coming back & asking for more & more information??

I am confused!! Please throw light if you know more details...

Will there be any chance to revoke or cancel approved i140 if we file 2nd i140 with same employer . My employer is willing to give approved labor which is better (EB2 ,PD-2003) than my labor (EB3, PD-2003) . But right now i am on 6th year . I got a 3 years H1B extension recently. If my first i140 canceled (??) how about my H1B . is it still valid?

My 485 is pending and and I am still working on h1. I have EAD and advance parole, but do not want to use parole to go to canada (Wanted to save it for India trip). Do I have to take canadian visa to travel to canada for 3 days based on my currnet status. what is the process to take the visa?

Can I change to different employer while the i140 is pending and also keep the PD. What i would like to do is..i want to change to a different employer and ask the present employer to keep the i-140 process as it is.

Is it ok if the i-140 gets approved while i no longer work for that company. I understand if i get any RFE, then employer need to respond accordingly.
