You are only counted against the quota once for a 6 year period , so I believe, she won't come under the quota , although it's getting harder to get H1B extensions every day

We have filed for our I-485 application.
I came to know from one of my friends that we do not receive our EAD after 90 days of receiving the receipt no
we can go to nearest immigration office to get it.
Is this the right span of time or we need to wait for more time.
How does this work.
Thanks in advance.

Some paras from Testing Time for Democrats (http://www.washingtonpost.com/wp-dyn/content/article/2007/03/05/AR2007030501185.html)
The story of the new Congress is actually two stories. Democratic leaders and their grass-roots supporters will decide in the coming days which narrative will prevail.
In January, Democrats dominated the news, the public agenda and the Republicans. In the last weeks of February, the Republicans came back -- not by offering grand proposals but by using the limited tools they have to prove that Democrats don't have enough power, yet, to end the war in Iraq.
When they took control, Democrats looked crisp and disciplined, attributes not normally associated with their party. Speaker Nancy Pelosi's House quickly passed the Democrats' popular campaign promises, including measures on the minimum wage, stem cell research, renewable energy and reforms of the student loan and Medicare prescription drug programs.
This agenda had its skeptics, but it provided focus for a party long out of power and drew significant Republican defections, feeding a raft of "Republicans in Disarray" stories. Pelosi noted at a January news conference that so many Republicans voted for the Democratic proposals that one of her colleagues joked: "Maybe you made these bills too easy."
The Senate Democrats quickly pushed through a different version of the minimum-wage increase, and the party's leading foreign policy voices framed a critique of President Bush's Iraq policy that squared with the public's increasingly skeptical view of the war.
But recent weeks have held nothing but trouble for Democrats -- and it is odd, as one Democrat noted, that they should be on the defensive when the scandal over the treatment of wounded veterans at Walter Reed Army Medical Center has focused attention on yet another failed aspect of the administration's execution of the war and its aftermath.
Instead, one news story after another has highlighted differences among congressional Democrats over how to end the war. There is also the divide between the Washington party and activists at the grass roots and in the blogosphere. All of these problems are rooted in two unalterable facts: Democrats, on the basis of their thin majorities in Congress, lack the numbers to force an unwilling president to alter his course. And they are short of votes to cut off funds for the war altogether.
My Comments
Dems are not united on most issues.
Although this article is on Iraq, a similar situation will occur on Immigration. The big difference is that Dems are very interested in Iraq (they won elections on Iraq) whereas I haven't seen much much Democratic interest on Immigration.

I just came back from India with my H1 visa expired and my wife had a valid H4 visa until May. At the port of entry, Immigration officer told me that since she is on my dependent visa, she had to enter on AP also. so both of us used AP though she had a valid visa

Hello all,
I entered US on a valid h4 visa on june 2007.Filed for a h1b on march 2008 and got and stamped h1 on sep 2008.Cud not find job due to recession.Converted back to h4 on oct 2009.I have following questions
1) Is it possible to convert back to H1 or fresh H1 ?
2) will the time period i spent on h4 will be counted for my h1?
3) When i stamped my h1b earlier(oct 2008) it showed validity till sep 2011.Does that mean I have to apply h4 to h1 before that?
4) In case if i get a RFE on converting from h4 to h1 Can i stay back on my existing h4 visa?
5) I havnt ever worked on my H1 will that affect my conversion from h4 to h1 now?
It will be great if you can answer these questions.
Thanks,
Lucky

From a press release from the New Orleans Workers' Center for Racial Justice: Secretary of Homeland Security Janet Napolitano has dispatched her top detention advisor to Basile, Louisiana to meet with detainees who have monitored conditions and staged hunger strikes in the isolated ICE detention center during the last month. Dora Schriro, Director of the newly created Office of Detention Policy and Planning, is on her way to the South Louisiana Corrections Center now. Meanwhile, detainee Edgar Nelson Bojorge Alcantara entered his sixth day on hunger strike today. He and other detainees in the facility have held five hunger strikes...

I am working on OPT and my spouse is filing AOS/EAD/AP. What happens till it is approved? Can I work?
yes, you can work on OPT till EAD comes. Once EAD comes, just file a new I-9 with EAD and continue working.
Remember, in OPT, you do not have to pay social security tax. Once you switch to EAD, you have to pay social security tax.

I applied for my concurrent filing during the July 07 fiasco. My I-140 is still pending approval. I am hoping that it gets approved within the next month or so...my question is ...when can I switch companies for a same/similar job if I wanted to? Since my I 485 has been pending for over 180 days do I need to wait for my I-140 approval? if I do have to wait, can I switch as soon as I get my 140 approval?
Thanks!
Thanks!

Cuban-born Andres Alonso is the CEO of the Baltimore City Schools. Alonso graduated from Columbia University before going on to get a law degree and a doctorate in education at Harvard. Alonso was interviewed on NBC News last night about how federal stimulus money is helping to keep his school system running smoothly this year despite the economy. Alonso brings an interesting background to the job having worked for one of the top law firms in Washington, DC as well as a teacher in inner city Newark, New Jersey. It's been several years since the employment-based preference categories developed huge backlogs. However, no one was prepared for today's announcement from the State Department that most of the family-based categories will retrogress between one and three years beginning on January 1, 2011. Consider the worldwide categories: Beginning in January 1, the 1st preference category (unmarried sons and daughters of U.S. citizens) goes from a 5-year to a 6-year wait. The story is much, much worse in the 2A category (spouses and children of permanent residents) where the wait expands from a mere 4 months to 3 years, a 9-fold increase....

Dear All,
1. I was on H1B with company A from Januray 2003 to January 2008.
2. I am on L1A with company A from February 2008 which is valid till December 2010 (my 7 year limit on L1A ends by December 2010).
3. My Labor is applied in October, 2009 by company B.
If my labor is approved or labor pending for 1 year, can I reactivate my old H1B with company B and start working with them.
Please advise. Mr. Dhoni
