Have anybody feeling the big difference between Texas and Nebraska service center processing? Texas is giving greencards and June filers most of them have got EAD and Advanced Paroles. Is immigrationvoice doing anything to escalate the situation.

It wouldn't have quite the resolution of the 20D, but the build quality and speed is undoubtedly somewhat better. If I could afford one today, I'd get one. :D

I have a situation where I need to dump my emp after working for almost 6 years as I am getting new opportunity which requires emp to pay me on 1099(instead of W2). Can it be possible and also can I avoid opening LLC. Also, not sure if in the near future if I get a RFE how that would go with current situation

I don't meant to scare you but this shit usually happens when they are reconsidering the decision when the sponsoring employer withdraws your H-1B. Check with your company's/lawyer if they accidentally submitted withdrawal of your H-1B petition.

Last Friday was a depressing day for me. A businessman and his daughter visited me in my office. In 2002, I left my employer(A) and joined another company(B). New employer applied for my h1b and in 3 months we got an RFE. Coincidentally, I did not like that job and just left that employer(B) to join the previous employer(A).Never tried to get the h1b reciept from. Now that company is folded and there is no information about that company(B). Later that year, company B gave me a W2 for 3 months pay which I had to file later that year.
While applying for 485 in june 2007, in mad rush I had to fill up G-325 form and I did not write anything about working for company(B) for 3 months. Rather I mentioned that I worked for Company A thru 2002.

Candidates already in the US may, if they are on a non-immigrant visa (such as a B1/B2 visit visa), be able to apply to the BCIS for adjustment (if changing to immigrant) or change (if changing to other non-immigrant) of status while remaining in the US. This option is not open to candidates who are present in the US under the visa-waiver scheme. Also, if the candidate did not advise of the possibility of a change of status to the relevant US Embassy or Consulate beforehand, USCIS may be reluctant to permit an application for adjustment of status.

Can labor and I140 be filed from an employer, even if employee is not working for that employer currently, may be with the intention of joining that employer at later date? Please reply.

Yes. GC processing is for a future job. So, labor and I-140 can certainly be filed without being on the payroll. I think I-485 also can be filed before joining the firm. But you should confirm this part from a lawyer.

I am also in same boat. but I havn't filed I-485 yet, and in oct my I-140 got denied.
My EB2 was converted to EB3 while responding to previous query on EB2.
I want to opt only for EB2 cate.

I am masters student graduating in June 2011. I got an offer from a big company and it already started h1b premium processing(applied on Mar 31). Now, I received an offer from my dream company and I didn't mention about h1-b processing and want to work for this company. I have few questions and need your suggestions.
1. Reject the first company offer. Not sure if I have to pay, because they applied for H1-B premium processing. How much I have to pay in this case? Can I continue working on OPT in this case?
2. Inform the second company about the first company h1-b processing. What can second company do, if H1-B is already processed? What can second company do, if H1-B is not processed?
Please suggest if there are better ways to handle the situation.
-- How long does it take to get H1-B visa under premium processing, if applied in 65000 pool?

I am on H1B and still 4+ years are left on my new H1. I have got my I-140 EB2 cleared in July 07 and applied for I-485 in Aug. Got EAD in Oct.
My question is what is the better option out of the following to change employer:
1. To transfer H1B to new company with the same Job Title as was in previous H1B. I have good relation with my existing employer.
2. Or I can invoke AC21 and start working on EAD with new employer (after 180 days).
Questions:
Q1: If I want, can I come back to my existing employer on same old H1B (if thats still valid) ?
Q2: I frequently go to India (at-least one time in a year). So with EAD and AP, there might be more waiting/ filing each year etc.
Q3: Which is the better option for me - H1B or EAD ?

In Mid 2007, 7th year of H-1B transfer & extension was filed, and was no problem as I had an approved ETA-750 with ex-employer, but it was expired soon as the sponsor�s (ex-employer) company was closed at the end of 2007.
The 7th year approval period was 12/11/2007 ~ 12/10/2008 with the current employer.
I filed another labor certification (ETA-9089) on 10/23/2007 which was sponsored by my current employer, and it has not been approved yet.
Using this ETA-9089 pending more than 365 days, I filed an I-129 extension for 8th year of H1B last November 2008, but INS sent "Request For additional Evidence Sent" letter which was saying to be provided �An evidence of pending / being processed for more than 365 days of labor certification or I-140 prior to 6 year expired of H-1B�. we just realized that a memo was posted regarding this on 05/30/2008.
As I don�t have this evidence... Please advise or recommend me...

My PD is Oct 2004. LC filed in TR. Should I push my company to file convert the case to RIR? How much time does is take? How much time does it take to file for 1-140 and get it in premium processing?
