Sorry, that revelation just made my head explode. The "You Lie!" Congressman claims to have been an immigration lawyer before going to Congress. I'm working on whether that is true or has the same truthiness as the illegal aliens in the health care bill myth.

It has come to the attention of the Office of Foreign Labor Certification (OFLC) that due to a technical issue, a number of cases were inadvertently identified as pending PERM re-file applications and were withdrawn from the backlog. OFLC is working to rectify this situation immediately by identifying the affected cases, and reinstating them back to the appropriate processing status in proper order. This effort will be completed by November 30, 2006.
Although affected employers and their attorneys will NOT be receiving an additional notice of reinstatement, they may verify their case has been reinstated using the Public Disclosure System (PDS) starting December 1st. Since verification will be available online, employers and attorneys are requested not to contact the Backlog Elimination Centers regarding status.

According to the mathew ohio website. there is apparently a very hot legal battle going on between the DHS and a happless immigrant who had been arested for out of status presence. The immigrant was on an H1b and had filed an application in a timely manner and was awaiting decision on his application when the DHS official arrested him and tried to deport him. Please post more information on this issue if anybody is aware of it. His I-94 expired, however, his petition for H1b extension was pending!!!!:o:o:o

I heard now they are issuing passports in less than a week.
If he has a GC he can still visit on his old country passport without any issues.

Hi all,
I am resident of CA and have my I140 application approved from Nebraska. My I485 application was filed in TSC. Is this a issue since according to USCIS, CA residents should file in the NSC. Will my I485 will be rejected because of this issue.

My wife had a H1B working for company A from 08/2003 to 07/2005 (from I-94) and she filed another H1B application to work for company B in 05/2004. She got the notice, stopped working for company A and started working for company B. However, she never got the aprroval notice for the second H1B application. Actually this case is currently still pending. She worked for company B until 07/2005 which is the expiration date of the first H1B. She changed to F2 later in 07/2005. I was wondering if there is any problem about status or employment authorization for this period of time from 08/2003 to 07/2005.

Hi Folks,
My friend's 485 is pending with CIS and he is working on EAD. He currently does not hold any other visa. In fact his last H1 expired more than a year ago. We recently tried to renew his EAD online on USCIS website. However, we were stumped by a question which asks the applicant about his/her current immigration status in US. It was a drop down box and had many options like H1, L1 etc, but there was no option for somebody like him whose current status is just "AOS pending".
How do we get around this? Do you think it is best to apply on paper?

Can I apply for EAD for spouse on the basis of I-140 approval? I can not file I-485 due to retrogression and he is running out of her H1B visa limit.

If you watch the video somewhere around 32 or 33 mins, he talks about the same idea implemented in Canada. They said get 400K buy a house here and get a canadian passport this helped reduce housing inventory in canada. So may be this will give some inspiration to people supporting the idea of buy a house for green card. What i assume that people need to have 400K cash and not loan from a bank to be considered an investment in the country.
At 45 to 46th minute of the video he clearly says that raising taxes and protectionism is not going to help economy.. I hope Obama takes note of it.
At 52nd minute he bashes Vikram pandit for being CEO of citigroup. Overall a good video to watch for traders..
