Hello Everyone,
If primary applicant of I-485 uses AC21 and Spouse of primary applicant not planning to work for at least 3 years because of infant kids. Could we please share what are advantages and disadvantages you can think of for not applying an EAD for secondary applicant until ready to find a job?
Following are list I can think of.
Disadvantages
- Secondary will not get SSN and tax rebate
- Would have to renew for 3 years even though not going to use
Advantages
-If get lucky get a Green card without using EAD ever
I have heard issues with Driving license but that's with having EAD.

I am filling out an LCA online for an employer who is hiring someone as an H-1B transfer. I am using iCERT and had a question as I go through the process:
Part E. Attorney of Agent Information
16. Law firm/Business FEIN:
This sections asks me for my law firm tax ID number. However, I am a solo practitioner so do not have a TIN or EIN - I use my SSN for taxes etc.
If I leave this part blank, or put N/A will this make them deny my LCA? I called their help desk, but am waiting (who knows how long) for them to respond.

Hello all, my apologies if you find my question naiive. We got our fingerprinting appt. notice in the mail yesterday with an EAC application no. When I look that number online it says case has been transferred to Texas and notice of transfer sent. Fine. I am not anxious or anything just wondering if a receipt will be generated now at Texas or would one have been generated at Nebraska and sent to the lawyer? The reason I as is I have been holding back travel plans and wanted to start looking at flights etc. if I know the receipt is either on its way or at the lawyer's already.

BTW the application was sent to Nebraska on July 30 and I140 had already been approved from Nebraska earlier this year.

Illegal non-immigrants did the rally to local USCIS offices. It would be good if we pick one day in 2nd week of July and have a rally to local USCIS offices. This will immediately catch the media attention.
Rally news should be spread out to media so we can get enough coverage?

I am currently working on H1B1 � and my visa is valid till May 2009. The visa on passport (from last employer) is valid till March 2008. We applied for green card through my spouse�s company � our I485 has been applied (His H1B1 is valid till Mar 2008). We both got our Advance Paroles, and he got his EAD � about 5 weeks ago. Though my EAD was also requested at the same time, I have not received mine as yet.
Due to my husband�s job we are moving to another city in November. I plan to resign from my job at the end of November, and go for 6 week vacation to India. I plan to look for a new job (hopefully on with my EAD) when I get back in January 2008. I have following questions:
1. Now when I resign & my H1B1 gets cancelled, what would be my status in USA.
2. Do I need to get back to H4 status to come back to US (or just AP would be enough for POE)
3. Do I need to get back to H4 status to stay in US

I did not find much information about this subject here. That is the reason for this post.
Any thoughts on transferring from BEC to PERM? I know that some folks in my company who applied recently with PERM got approval in less than a week!
I am wondering if anyone has already tried to transfer from BEC to PERM and what their experience has been?
I know that it is risky as it involves closing the pending case in BEC before opening a new one in PERM. The risk of losing the original PD is very high, especially for those of us with > 6years of H1.
DOL was supposed to get back with more clarification on the subject of transfer after gathering stakeholder comments but have not anything about it from DOL in months.
I did not find much information about this subject here. That is the reason for this post.

Dear Attorney,
I am a July 2007 I-485 filer. Have an EAD but primarily working on H1B full-time as a Systems Analyst. I am a Certified Fitness Trainer but not sure if I can use my EAD to work as a Fitness Trainer in a local Gym (part-time).
Any advise will be much appreciated.

No more interim EAD at Infopass since Sept 2006.
If it's an emergency like loss of job offer etc. you can take a cover letter with your receipt notice to Infopass and they can fax it to the Service Center for expedited service. Alternatively you can fax it yourself.
The decision whether to expedite your case rests with the Service Center.
Also I would say hang on for a few days if possible. I got my EAD approval e-mail after 101 days since RD from NSC.

We have applied for our 485 under EB2 I with a PD of Jun 2005 (I am primary and my wife is the dependent). We have maintained our H1B status though have used AP for travel.
Its time to renew my wifes H1B within the next few weeks. With all the talk of spillover and a remote chance that may be our 485 gets approved during the last quarter, i wanted to know if there would be any problem if our GC got approved while the H1B remained pending or worse the H1B got approved too around the same time the GC got approved. [i am hearing that it is taking a few months for H1 approval]
Is there an process that we need to follow - withdraw the H1B once we know that the GC got approved etc.
Also is there any problem with H1B renewal if AP has been used?
Any help wrt both these topics is appreciated.

The American Immigration Council, an organization that does great work fighting for immigrants, annually honors immigrants of achievement. If the investment property was under passive investments like absolute NNN lease or TIC investments, then I am guessing it should be alright. Check with an attorney first.

1)Company A (GC sponsoring company) filed H1B 3 years extension based on approved 140 six months back and it is pending since then and got RFE .My previous H1B expired 3 months back.
2)Now i would like to switch company B by using AC21 and want to file H1B renewal also with company B.
Is it possible to file H1B renewal with company B by using pending receipt notice of H1B (that was filed by company A)? or do I need to wait until get H1B approval that was filed by Company A?
Experts please suggest?
