I wasn't planning on porting my PD until I read this nonsense "Injunction" threat. I will now port my PD; GCTest - go and file your injunction. If you don't have enough balls to do that I can lend you one.
That memo/document you pointed out is an interpretation. We have already said that USCIS's interpretation is incorrect. We intend to correct this interpretation with this lawsuit.
Infact, it would be wrong to call this a lawsuit.
We are aiming for an injunction (or a stay order) in step 1 of the lawsuit that would prevent USCIS from working on any interfiling/PD porting requests.
If the injunction is with retroactive effect, all the EBs (not just EB3) who have ported their PDs will have their cases frozen. USCIS would not be able to work on them.
The remainder of the lawsuit can take its sweet time... the injunction should serve the primary cause.

can they even withdraw 140 after more then a year now?
employer can withdraw the 140 any time before the approval of 485 - there is no time limit.

2) This forum needs to keep it's focus. Members are supposed to help each other and our cause. We are IV and IV is us.
3) we do not need internecine fights, that digress's from our mission.

You have some more in other science related disciplines like TIFR (not sure if they give M.S. degree).
I did not see MS in any discipline.
They had PhD CS also; my friend got PhD from there.
They also had something like a CS diploma (don't remember details). They had 10 (??) theoretically sound courses. Students in most US schools will not be able to handle these courses.
However, course content is not the only strength of US Education (all levels). Something else (which is hard to enumerate and quantify) happens outside the classes. But it does not happen to everyone: some are not receptive and others don't run into it!

I had started a healthcare thread previously and it got poor response. Eventually we created an iv-physicians chapter to track our issues and work with the core team on the overall goals of ending retrogression.
There are a number of efforts on to help Schedule A applicants, some of these are parts of more comprehensive efforts like Cornyn's recent amendment.
I suggest you organize the Schedule A folks into a group. IV is very happy to work with any group that takes responsibility for their own needs.

If you do form a group, try to expand it by bringing members in from outside iv as well- this would also expand iv's membership base.

You have been calling H1 PD will be fair for some time now. I dont think it is. It is infact unfair for those who have the intention to immigrate. (Sorry to say this time and time again)

This was one one of John Kerry's Presidential campaign proposals. you saw what happened right. As the other member said it would be something very difficult to get pass by rule makers.
How about something like,
If a person has stayed in US for 10+ (or 7+years) years and has filed taxes(verified thourgh 1040s), he should be given GC. No questions asked(other than the ones the affect security of USA)

There are many people who have contributed and will be contributing again. But can I know how would more money would have helped convincing Senator Sessions to say "Yes" for the bill??
I am not sure if more money would have passed the bill in Lame Duck session without Senator Session approving it. Also, the lawyers ask only for the service they render to you. They dont ask money for keeping your application with them and unable to process because of retrogression.
You may want to get in touch with core members if you have questions. They are very prompt in answering questions.Such posts will only create roadblocks to the momentum created on the forum by some of our members. It is time to help rather than ask. We have seen in the lameduck session how close we came to getting the bill passed. If IV was not there, even this much was not possible. These are all good thoughts but what u are suggesting takes some time.

Leg 1: Process fix
Leg 2: Increasing number of greencards
What I am talking about is leg 1 and what you are talking about is for leg 2
and both are required.
Even for leg 1 - unless it is organized, nothing is going to be effective. What you suggest is an immediate action going back and forth based on frustration due to recent happenings - and I say it maybe good but not the most effective.

LOL. :) If I am a volunteer as an IO, I would get the names of all IV members, write a small script to approve their GCs, make sure the cards are delivered to the members, and immediately resign my job. :D

Listen to what he says about how India is racing ahead despite all the problems with education. I was disgusted with the quotas and poor education in India.
Learn to deal with the truth whether you are Indian or American!!
ya just because u need green card, you agree with professor sahib. once u get ur green card u will also talk bad about india and indian workers.. i think gone r days when it was a cheap labor.. do u think our education systems/colleges IIT's/REC's are crap.
just because he favored GC applicant you should not agree..he straightway projected india as third world nation in eductaion, resource quality etc ..

Its been close to 2-3 weeks since Ombudsman's office got to know about this issue. Inspite of them contacting TSC they still do not have a response yet. So now its time to send Ombudsman's office with completed Form 7001 so that they get to investigate your individual case and assist you. They are obligated by law to investigate and respond to your request. The more people send out those forms, the more important it becomes for them to address this issue on a priority basis. So please take the time to mail out the forms soon.

I am not sure thats correct.
Per IRS regulation Section 163 (C), as well as Publication 936, interest paid on primary and secondary residences up to an aggregate one million dollars in loan amount is tax deductible. The IRS regulation does not specify that the home must be located in the United States, and thus it seems logical that interest paid on a home loan on property in India is in fact deductible
(please consult your tax advisor for applicability to your specific tax situation).
You can quote any IRS publication/regulation, which is issued bt IRS with the assumption that the Lender issues a 1040 to you and simultaneously notifies the IRS the intrerst earned by the Lender from your Mortgage .
And the point is how do you show the intrest paid on the Mortgage if the International Lender does not issue a 1040. Any attachment/print out you provide showing the intrest you paid is not suffice as long as the IRS does not know that intrest was not accrued in their File. Since International Banks dont register their intrest earned with IRS.
All I mean to say is, it is a Closed loop sytem where the Lender registers his intrest earned with IRS and sends a 1040 to you so that you can claim the tax exemption based on your intrest paid
