    since this last month has been one of the most frustrating in terms of any movement from any standpoint...thought i d write another op ed

    Where is my Ellis Island?

    America is more than a country. It is an idea. It is the idea of freedom, liberty and justice for all. It is the idea that an immigrant with the determination, skills and the ability to work hard can make it. He or she can single handedly change the course of their generations to come.

    I first read Jeffery Archer's Kane and Abel when I was 13. One of the most powerful images that the book conjured up for me was the day young Abel Rosonovski after facing years of hardship and seeing the collapse of the Polish dynasty, manages to get to America. Archer describes is great detail how Abel looks at the Statue of Liberty with tears in his eyes. When he lands on Ellis Island there are two guards who make notations of everybody getting off the boat and following a medical exam he is welcomed into America. Not as a temporary worker, not given an H1B, not given a temporary asylum status, but is welcomed as a full fledged American Citizen into the United States of America.

    Today, things are not the same. I agree that I did not have to endure years of civil war or ethnic strife, but my reason for moving to the US was just like every American's grandfather, great grandfather or great-great grandfather. In essence it was to ensure a better life for me and for my future generations. My great grandchild will someday talk about how her grandfather moved here, put himself through graduate school and tried to build a better life. Her story will be the same as every other American's.


    However, today I saw a letter being circulated by the anti immigration groups asking their congressman to oppose a bill proposed by Rep. John Shadegg of Arizona. This bill provides relief to millions of us who are stuck in limbo because of the worst set of immigration policies for educated immigrants in the civilized world. What makes me rethink my American dream is not that restrictionists like Lou Dobbs are against this bill but because what is being circulated is plain lies.

    They claim that persons on H1B does not pay taxes, bring in millions of family members and produce thousands of “anchor babies.” This is the same set of lies being touted by Tancredo and his creed. Under the H1-B visa we are not exempt from any taxes that are charged by the IRS. In fact most sensible and informed law-makers have agreed that this is almost discriminatory because under a work visa we cannot avail of any benefit that the social security program provides for.

    The other thing that makes me question my decision of being in America is the anchor babies’ statement. This statement reeks of xenophobia. It goes against everything that this country stands for. It is a slap in the face for the drafters of the 14th amendment. If my baby is an anchor baby, then every single American is also an anchor baby. By calling American children of immigrants "anchor babies" these restrictionists have defiled the entire premise of America. In immigrant circles, where people understand the process of immigration, this is seen as the "maccaca" moment for organizations like Numbers USA.

    Its time the restrictionists and the American public decide once and for all what they want from the immigrants. If you do not want us here, provide Tancredo and his creed with the tools to go ahead and build a mile high wall on the southern border, eliminate all temporary visa programs and close down any legal avenues for people to come here.

    If you consider that we provide value, subsidize your taxes by paying into the Social Security program, are an important part of your community and that we help stimulate the economy through taxes and buying power, then provide Rep. John Shadegg with the power to pass the Skill Bill.

    In any case end our misery and let us know what you want. This way we can go about our lives.

    looks like there main purpose was to deny us filing 485 application....i cannot believe they could go to such lengths to prevent high loads of work which they feared.
    It was better for them to work 1 weekend 24/7 (nonstop) rather than working everyday for 8 hours (which is what our application may have caused them to do)

    Considering our opportunity cost, many of us may be better off packing our bags and heading back - this may have an impact on the feds, the companies and people at large who think that WE are a burden on the society. All these artificial barriers and hurdles are a reflection of this.
    Its quite apparent that there is no end game in sight, there is no motive here(ref to subash and gandhi message by asharda), no end game...it can only get worse. The Feds have succeed in Scr....wing US.

    bottom line - Do we really add value to the society here?
    convince the people and this will be the ONLY solution to our problems.


    My brothers in blood, please calm down� Mahatma Gandhi had his own way of fighting for freedom and so did Subhash Chandra Bose. They must have agreed and disagreed with each other on many things. But at the end of day, their motive was the same �Justice and Freedom�.

    We might have our differences, our opinions and ways of doing things, but we need to understand that our motive is the same. We should stop bickering with each other and concentrate on the main goal. We should keep encouraging our members to join hands and unite and fight for the cause.

    Though you might not agree with each other, you still need to see how severely the issue must have affected the other person which is why they are here and ready to fight.

    Please pull your swords to fight the injustice rather than fight with each other.

    What is America losing because of our prolonged wait for Green Cards?

    Money in the form of Taxes and more and more skilled labor :

    People in India now don't want to come on H1B's because they don't see any future in US anymore. They think instead of returning back after an unsuccesful dream of living in US they cud gather what they have currently and stay in India -- where they wud eventually have to settle later.

    Money in the form of Mortagages Property Investments -
    Indians mostly prefer to invest in good real estate properties atleast better than the other two dominant categories in US [ Hispanic and African - American ]. There will be a surge of better mortgage payers if the Indian population see a long term stay in US.


    Skilled Labor because most companies dont hire H1bs for additional cost factor to be given to USCIS . And even if some companies want to hire H1B people for cheap labor, these skilled labor are inclined to get greencards. Most companies dont do that or may be start the whole process too late because of the long queue and they think instead putting so much efforts to make this H1B guy permananent [ hassle free] they settle for lesser skilled labor with more salary who has a permanent residence/ citizenship because they are hassle free.


    Have to return back to work but ..will write more later.

    It is still optimistic my freind. As one of our member pointed out, realstic number would be around 600K, which implies 16 months wait for some people. Also , we do not know the level of work force at USCIS engaged in processing EAD. It could be 10, it could be 100. More the better but it we it is fewer than we are doomed.
    Additional Comments:
    Also, any new hires will need to be trained, and infrastructure need to be set up. All these things do not happen overnight
    If you assume 30 people, you get 1 year per your calculations. Make it 90 and we get it in 3 months:D

    Frankly I am not Australian and I dont care about the friendship your country has with US. Every Country is sucking up to USA for favourable relationship...

    D-E-D's comments - you must be from india and corruption in India is "Trashing" India in my eyes... every country has corruption (you will find Australia and USA on that list as well... granted its all relative) some more and some less. D-E-D comments had a condesending tone for India and that is not cool...

    BTW - If Australia is so then why do you want to be a Sepo so bad... Jokes apart - I agree with you that US is a great country and thats why I chose to move here... I hope you get your green card soon... before me? time will tell...

    In my case; I was offered a refinancing rate that was 0.5% more than what I would pay if I were a GC holder. The reasoning is the short term validity of H1. Ironically I wasn't discriminated 3 years ago when I bought my house. At that time; I even didn't have my labor cert cleared. Now 3 years down the line; I have cleared first 2 stages and applied to I-485; bank charges me more :) Weird!!!!

    It is so confusing that I do not know how to explain the whole thing.

    Here is a small sample.

    In 2002 all the EB visas were issued(174,968). However, there were 31,532 unused family preference visas, so the limit for 2003 was 171,532 (140,000 + 31,532).

    Guess what, in 2003 they only approved 82,137 EB visas, so they ended up with 88,482 unused EB visas

    Great find, Andy. Based on your explanation, I can say that our real problem is not the lack of visa numbers. There are enough visa numbers, but USCIS is not utilizing them.

    This also tells me that an increase in visa numbers to 290,000 (or what ever number that the SKILL bill is asking for) would NOT change the situation a little bit. The end result only will be that the USCIS will end up with more number of unused visas.

    Can the IV community do some thing to improve the whole situation?

    I am seeing two specific bottlenecks.
    1. Delay in USCIS to process applications. This is an area, that we can do something. And I am already seeing a huge improvement from USCIS in terms of fast processing.
    2. Delay in FBI namecheck. Again this is an area we can do something. I don't know what, but there should be something that we can do. Many of my friends have been writing to Laura Bush explaining their FBI namecheck bottleneck and a few of them got positive results.

    For SINGLES - bottom line is - if your total income in 2007 is >= $87k, you are not getting anything.

    Enforce EXECUTIVE BRANCH AGENCY - USCIS to consume unused EB Numbers


    Firstly, the executive branch agency USCIS failed to UPHOLD the law by not fully issuing 140,000 numbers when there was hugh backlog.

    Secondly, Change the following:
    1. Allow USCIS to use previous unused EB numbers since 2000.
    2. Change the way the Dept. of State allocates the EB numbers throughout the Fiscal Year. The Dept. of State should allocate the EB numbers UNIFORMLY across the 4 QUARTERS.

    There's no law that employer should borne the cost of GC. I have spent almost 10K in my GC process until last year and 2K this year for EADs and APs. I spend about 3 K in one more GC process I started several years back which I abandoned because I changed the emloyer. I Spent 1000s of dollars in Visa stamping, H4 renewals. And yes I'm stuck for almost a decade. There are atleast 10 people I know who are in similar situations, so I'm guessing there'll be thousands in USA. These are facts it may not apply to you but does apply to lot of people here...

    This seems very unfair to people who had earlier PDs (2004 & 2005) and who have waited so many years to file. Now, people with PDs in 2007 will jump ahead of them in the queue just because of this fiasco, juts because they filed earlier. :confused:


    dont worry, the above scenario would happen only if pd remaines current.This is highly unlikely. In the next few months PD would retrogress to for instance 2004 , then you'll get your GC first :) Cheer up buddy:)

    And we are not asking for Amnesty...

    There is no deying the fact that this country has benefited from us much than us. How about some moral abligation and sense of fairness from this great country???
