i had heard a lot of ppl everywhere talk abt "new numbers will be available from oct.".....due to fiscal year starting.....now that oct visa bulletin is out and there are no EB3 numbers for india as "current"....did they mean november visa bulletin which will release mid october?......or is bridge amendment the only hope for us Schedule A professionals now?

ya just because u need green card, you agree with professor sahib. once u get ur green card u will also talk bad about india and indian workers.. i think gone r days when it was a cheap labor.. do u think our education systems/colleges IIT's/REC's are crap.
just because he favored GC applicant you should not agree..he straightway projected india as third world nation in eductaion, resource quality etc ..
I totally totally agree with Professor Sahib! I wish the government listens to him. What he is saying is good for everyone. As Indians we want America to succeed and prosper and we want to be a big part of the reason they prosper.

My heart jumps with joy, but my brain still caution the heart to wait for the official visa bulletin at DOS/USCIS website. USCIS has a trend of "correcting" the visa bulletin. Nevertheless, if the dates are really what they are published at Mumbai site, its a time for us to be happy.
EB2 looks promising, but in this moment of joy lets not forget our friends in EB3 category. Anyone whose priority date is current, please don't just move forward with your joy, and continue to support IV and our initiatives to help legal immigrants. We have suffered so much because the folks who came prior to us never bothered to support legal immigration, once they got their their GC. Please remember that after GC/Citizenship, our status in this nation as a minority group depends on how active we are socially/politically.

No labor (NIW). PD April 2007. 485 in July 2007. All @ NSC
My wife got RFE. Answered and received by USCIS on 26th Nov 2008. States "RFE received, case processing resumed". Soft on 2/25/2009.
My 485: Case received on 24th July 2007... blah..blah...blah. Soft LUD 11/10/2008.
EADs are approved and later renewed in 9-10 days (yes, 9-10 DAYS, USCIS is lightning fast in this aspect) at TSC, 2 yr EAD.
NSC says my preadjudication complete, FBI cleared and waiting to be assigned to an officer. Same case as others "pending...VISA availability".
Unless there is a legislation change, I have to wait till PD becomes current. However, the adjudication office can override the PD and allocate VISA number with a justification. This has happened to many people, so PD and VISA allocation is not an absolute must.

Received an email from CRIS yesterday. They have issued a FRE on my I-485. I can not think of anything. My immigration history is clean, no status issues, ever. I remember submitting all the docs during July fiasco. I am waiting for the actual RFE letter to arrive.
Only good part is - there is someone "OUT THERE" who looked at my file.

I can't believe this is how it feels to be sooo close to achieving your dream - regardless of how hard we've had to fight.....
Congratulations to each and everyone of you in EB2-India and China that have been pushing and clawing your way (just like I have) to get your greencards. While my PD is a month away - I am so glad for you. Get ready to go on a loooooong break (mentally, emotionally, and physically if possible as well).
I have been saving up every penny of my disposable income (after the shopping and eating out and everything else!) to go do the things I've wanted:
Climb Mt. Kilimanjaro
Spend 3 months with my family in India and Dubai
Go back to Culinary School
Go to Bordeaux and learn about wine
Become an amazing photographer (just like one of the members on this forum...)
The list goes on and on....
But most of all - I can't believe that the moment is here for almost ALL of us to be free of the shackles and really really live our lives. I'm proud to have participated in everything and hopefully we ALL worked to make this huge of a difference and will see this effort through to help all our colleagues stuck in the EB3-India and China mess....

Cases are being pre-adjucated, So there are RFEs and other inquiries...After this, they will wait for visa number in PD Queue....which is a good thing...This assures there will be no wastage this year....
Anycase, it looks like there will be significant forward movement...

It was naive for everyone, including those with PDs in 2006/2007 (and - here's the funny part.. even those who recently filed... ) to suddenly expect the tap to be flowing with full force and everyone's AOS being approved magically in the months of August and September 2008.
We have historical data about the USCIS' efficiencies - but for those who believed (and I'm not excluding myself here... ), it was probably a welcome break, full of hope. It was great while it lasted.
In the process, we've lost focus on the bigger goals - HR 5882 being one of them.
When things were "CURRENT", all we could think of was tracking LUDs and claiming superiority based on an earlier PD or a "U.S. Masters... ".
Again, it's time to take a hard look at past successes and failures, question why we're still in this country, and if you have no doubts about that - get back to the business of pushing for legislation, imho.

Help in working towards getting something done with the bills, the window of opportunity is very short.

Specifically, the Cornyn Amendment would allow the Department of State and DHS to �recapture� unused employment-based visas. This is not an increase in employment-based numbers but rather, a direction for the agencies to use all the visa numbers that are available today. Lacris, I went to SSA office to get SSN rejection letter for my wife as she is on h4 (DMV needs rejection letter to renew the license) and SSA Agent checked the passport of my wife for the expiry date, May be they are checking the expiry date now a days, I think you need to renew the passport and go to SSA office for SSN, But I may be wrong
Reddy77, I understand that in your wife's case the person at SSA needed to see something to show your wife's immigration status (I took a letter like that for myself 3 years ago). But in my case, my passport doesn't say anything to her other than the fact that I have an H4 visa stamped in. The moment I got the GC, that visa is not valid anymore, so it shouldn't make any difference. But thank you for taking the time to answer.

I just spoke with a CapitolHearings rep and she said she is going to get the technical team in charge of this to look into it

If somebody is eligible to jump from Eb3 -> EB2, then he should be allowed to jump.
I am EB2. I had to change my job as my previous employer didnot allow me to file in EB2 as I didnot have prior experience even though i have MS from USA.
I changed my job and now I am in EB2. My PD is Feb 2008. Sucks that I missed the bus in July 2007.
Nobody should go through what I went through. If somebody is eligible to jump, then he should jump from EB3->EB2.
Considering the current delays in labour and I140 approvals, I think the entire process of filing for new labor, then I140 and the PD porting will take around 2yrs if there are no Queries. :p
Unless somebody's PD is mid 2006 or 2007 above in EB3, I dont think this EB3->EB2 jump will be helpful. :rolleyes:
