but as far as the AD is concerned, an AD is for a position not for a person, if 1 AD satisfy the skill set and available position then one AD can work for multiple positions.

This never gets highlighted either by media or public. Many of these employers are big time contributors to the candidates - and candidates turned lawmakers offer their loyal protection! Unless, this changes, the problem cannot be really solved

South Carolina Republican Senator Lindsey Graham has said many times in the past that the GOP needs to move back to the middle on immigration reform. He's putting his money where his mouth is and is leading the GOP's pro-immigration wing as they work behind the scenes shaping the bill likely to be introduced in the next few weeks. The support of at least half a dozen Republican Senators will be critical since there will no doubt be Democrats who don't vote with their party.

Can you use your spouse's cross-changeability after you have filed for your I-140 already ? How time consuming is this for the USCIS to acknowledge ?
i am quite sure you can...infact you can do this at any stage including after filing I-485.
please verify with an attorney...you will need one to do it correctly.

Hello All,
I will be appearing for L1 individual visa extension in chennai in a few days from now.
One the questions that would be asked by the VO would be "where and who do you work for". The second part is easy since i work for the petitioning employer rendering my services for their client. However for the first part of the question what appropriate answer can be given?
Can i mention the client name location in US since that is where i currently work although i am controlled by the petitioning employer. I would not be working from the petitioning employer work location in US. I believe the L1 Visa reform act of June 2005, tells that you can work from offsite location provided you are controlled/managed by petitioner.
Please advise as it would help me in responding with correct answer. Thanks.

Lets say, after getting EAD and AP and 6 months after filing for I-485, you want to switch jobs to another company but want to do an H1B transfer to a similar position. Do we still have to start the green card process from scratch to remain on H1B?

Hi,
I've been working full-time on EAD for the last 2+ years. I have a pending 485 application, on which my spouse is the primary applicant. I have never applied for H1B in the past, because I transferred directly from F1 (student visa) to this EAD.
My spouse also has an H1B, which is in it's 7th year (completed 6 yrs of H1B).
My spouse has been put on furlough (unpaid leave) for 3 months.
What are our options ?
1. Can my employer file H1B for me, and an H4 for my spouse ? How will this affect our green card application (on which my spouse is primary applicant) ?
2. How much time does my spouse have to look for another job (with similar job description), without being out of status ? Is there some grace period associated with H1?

As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

I got RFE on my wife's 131...
Last time we took our photos at Ritz Camera...they accepted mine but held her case due to these photo issue...
My attorney received this RFE and he scanned it for me..
Do we have to submit the entire app now?
