Hi Guys,
Just need an advice to what to do. My wife is currently on F1 and she is graduating in Dec'07.She has and EAD and AP since we applied for her I485 and even mine is pending. Now I have apply for her 7th year H1B extesion.So my question is do we need to even apply for my wife status change from F1 to H4.She is planning to use her EAD.
lets say even if we apply for status change now, can she travel on AP even though status change is pending.

I am adding my wife's AOS application to my own pending AOS application. Because of whatever reasons we couldn't file our apps together earlier.
I notice that I need to give my wife's Alien registration no (ARN) at a couple of places in the application package, such as in the I-485 form, G-325A form, and at the back of the photographs.
Needless to say, my wife does not have an ARN. I was allocated an ARN when my I-140 got approved. Since she is just a derivative beneficiary, she does not have an ARN yet.
So what should I do about these columns in the form. Should I leave them blank, or should I fill them up with my own ARN.
Please help

I am trying to analyse the impact based on 245i. Based on it
PIC countries benefited from unused visas a lot till now to have their PD current/move up. So based on that benefit, Also one thing is clear the unused visas if available are country indepedent and are used at the rate of 27% per quarter.
so for example 100K visas are available (which i would enjoy having )27K per quarter is available from the start of the year . Now among this 27K how is the distribution, can it be distributed whichever applicant needs PD IRRESPECTIVE of EB1,EB2,EB3(skilled, professional) Vs EB3 other or does it split by the calculations of EB1, EB2, EB3 with 28% EACH and EB3 other NOT above 10K limit

I am not sure if I am posting it in the right forum. So please excuse me if not. My cousin have some immigration case going on in San antonia, Texas court. She lives in California. Her court date is on 30th July in texas. I need help to find a good immigration lawyer for her. Could you guys please suggest me immgration lawyer (if possible Indian) there, so that I could contact asap. TIA.

I am getting ready to file for my 485. I have a problem, and I am not sure how to go about it --
My wife's birth certificate has her name listed differently than it is. The birth certificate has a temporary/pet name. Is there anything I can do now, in next 14 days, before I can file for 485? Will any kind of affidavit help?

I came in on an F1 and got transfered to a H1B without leaving the country.
My H1 was approved for 3 years ie till 2012.
Due to problems at my work place, my H1 got revoked by my employer.
I'm in the medical profession, hence, jobs are few and far between if removed form a training program such as I was in. The next cycle of jobs dont start employment till July 2011.
I am currently within the 180 day limit.
What are my options? My countrys consulate is known to be tight fisted with visas, especially as I have overstayed since I lost my job abruptly.
If my fiance and I do get married, am I eligible for for adjustment of status?
Please help!

E. APPLICABILITY OF INA SECTION 202(a)(5)(A)AS IT RELATES TO THE ALLOCATION OF “OTHERWISE UNUSED” NUMBERS
INA Section 202(a)(5)(A), added by the American Competitiveness in the 21st Century Act (AC21), provides that if total demand will be insufficient to use all available numbers in a particular Employment preference category in a calendar quarter then the otherwise unused numbers may be made available without regard to the annual per-country limits. This provision helps to assure that all available Employment preference numbers may be used. In recent years, the application of Section 202(a)(5)(A) has occasionally allowed oversubscribed countries such as China-mainland born and India to utilize large quantities of Employment First and Second preference numbers that would have otherwise gone unused.
If spill over has to happen every quarter as per the detail in above statement, why USCIS is not doing quarterly spill over, it looks like they are still doing annual spill over in to EB2 I and C. My question is am I interpreting the law correctly.Thanks for your help.

Hi
I have started(with a couple of friends) a non profit (University Alumuni association ) recently . Will it affect my GC processing in terms of queries or delays . I had agreed(verbally) to become the financial officer in the company (but have not made any written commitments till now ). The company is registered at my residence address by my friend and collegue although I have not signed any papers and made no financial transactions till date .
Please advice as soon as possible as i need to make sure that the tax return (deadline 15th May is also met with ) and I can get out of the picture if needed.

The Los Angeles City Council has approved a measure barring city workers for traveling to Arizona on official business and also banning the city from contracting with Arizona businesses. Some contracts for key infrastructure items are not affected, but the LA Times estimates that the vote will cost Arizona upwards of $8 million per year. The biggest contracts not affected are those involving the airport and sea port. But the civilian panels overseeing them are considering canceling contracts worth $26 million. My wife is laid off and her company is going to cancel her H1B soon. h1 petition is getting expired on Oct,2009. now I am going to apply for COS to h4. If she wants get H1 status after one year can she use the same petition for H1 transfer?. or she has to apply a new H1?.

Hi,I have filed H1B during August 09 ..my priority dates became current in Sep 09 and I have filed for AOS -485 /EAD ..Should I cancel my H1B or will it automatically get canceled once I receive my EAD ?Please suggest.
