The Memphis Commercial Appeal reports on today's citizenship swearing in of Irish-born James Patrick O'Donnell. Mr. O'Donnell immigrated to the US at the age of 4 in 1926 and fought for our country in World War II and won a Bronze Battle Star. In 1987, Mr. O'Donnell applied for a passport to go on a cruise and was told that he was not a citizen despite his clear recollection of being naturalized before shipping out during the war. Hi,
My spouse was on H1, the applied for H4 which was approved but he start date was incorrect, so an I102 was applied to get the I-94 corrected , we got the dates incorrect again so the lawyer applied for correct of dates again (October 2010)
In the mean time, we had a family emergency and my wife had to go to India , She went on a valid AdvanceParole. ( We have a pending 485 , so got an AP also)
Today we received a mail from USCIS, asking her to attend an interview regarding this I-94 replacement.
. She is not in US
. She submitted all the I94 cards she had at the Aiport
1. Will she have any problem coming back. She was always on Status. NO issues there
2. Is there any way to postpone the interview ?
3. Does it affect my I-485
4. What is the best course of action

Hi All,
I have H1B stamped from company A which is valid untill Oct 2008. I am planning to go to India in Jan on my new transferred H1B from company B.
Do I have to take an appointment in India for getting my new H1 stamped? Or can i just show my new approved H1B from company B on my port of entry in US, when I come back?
New Approved H1B is enough.You don't need visa stamp again.

I am from California. One of the requirement as you all know is Notice of Job posting with SWA. We have a new person in our HR who deals with immigration the earlier one left .
Problem Description: According to our new HR posting jobs on http://www.caljobs.ca.gov/

We like to share that the H1B cap is extremely close to being reached. The count as of December 15, 2009 is 64,200. This is 1300 cases more than the count from December 11th. This count is very close to the total cap of 65,000 which is actually somewhat reduced by numbers allocated under trade agreements. We continue to watch this very closely, and will provide updates until the FY 2010 cap is reached.
We suggest to act quickly to avoid last minute embarrassment as H-1B Cap may soon be cease to exist.

The big news is that the masters cap was hit as of December 24th. I had been predicting since last summer that this 20,000 quota would be hit in the last week of the year and the pace of usage stayed extremely consistent. The general quota has 7,700 visas of 65,000 remaining as of December 31st and the rolling four week average is now running at just over 1500. I would apply for the renewal EAD now. Are you using the EAD to work ? Normally if the EAD is not approved after 90 day wait, then one can get a temp EAD form the local office. Give yourself some time, just in case something gets dealyed.

I am currently a H1B visa holder engaged to a US citizen. We are planning on going to India soon for the formal engagement ceremony and getting married early next year.
I had two points of concern:
1. Upon returning after the engagement, I will still be on H1B (since the wedding is going to be a bit more than 90 days after the official engagement so the K1 visa is not an option), will this cause issues at port of entry?
2. After marriage, we plan to go abroad for our honeymoon (we likely won't have time to file anything with immigration before our return): how should I proceed upon reentry then or is this even advisable since I'll be returning on an H1 but be married to a US citizen?
Any advice would be greatly appreciated, thanks.

Hello,
I have an approved I140 and eligible to apply for I485. My wife is in the same situation.
Should we file separate? Or should I file only one application heither through my employer or hers?
Any clarification in this matter would be greatly appreciated.

I am also in the same situation that my company's attorney is not giving me I140 receipt number. They just say that it was filed in first week May but don't have the receipt number yet.

I have I-140 approved with PD of Aug-2007. I-485 is not yet applied. My 6 years on H1b are over. I got 3 more years of extension till 2011 on H1B based on I-140. I have also got the extended H1b (till 2011) stamped on my passport. Now I am looking to change my company before lay offs happen.
What are my options :
1. Can the new company transfer my H1B and I-140 ?
2. If they can just transfer my H1B, what happens to my PD of I-140 ? And what I may need to provide or tell the new company in case of transfer ?
3. How many years of maximum extension should I expect from the new company on H1B ?
4. Do the new company has to start GC processing ASAP ?
